بیانیه جمعی از وکلای دادگستری ایران در حمایت از مردم ستمدیده روستای چنار محمودی لردگان چهارمحال و بختیاری

احتراماً اینجانبان جمعی از حقوقدانان و وکلای دادگستری ایران با استناد به اصول اعلامیه جهانی حقوق بشر، منشور حقوق بیمار و سوگند نامه بقراط به استحضار می رساند:
تمامی شهروندان از حقوق درمانی و حق بر سلامت باید برخوردار باشند و دولت ملزم و مکلف است تا ضمن حفظ کرامت انسانی ایشان، خدمات درمانی مطلوب و رایگان را بر اساس مناسب ترین استانداردهای جهانی در اختیار آنان قرار دهد؛ از دیگر سو، هر شهروند از این حق برخوردار است تا از روند درمانی خود آگاه باشد و رابطه بین بیمار و درمانگر، باید مبتنی بر رعایت حقوق بیمار و بر پایه اخلاق پزشکی باشد؛ اما شوربختانه مدیریت ناکارآمد پزشکی در ایران موجب شده تا بالغ بر دویست نفر از شهروندان محترم روستای چنار محمودی لردگان آلوده به ویروس اچ.آی.وی یا (ایدز) شوند. نبود نهادهای مدنی و سیستم قضایی مستقل و عادل در ایران موجب شده تا اطلاعات دقیق در باب چگونگی انتقال این ویروس مشخص نشود اما آنچه حائز اهمیت است این است که قبلاً قصور دولت در پرونده خون های آلوده به هپاتیت و ایدز به اثبات رسیده و دولت در این حادثه نیز وفق اصول فصل سوم از قانون اساسی و مقررات قانون مسئولیت مدنی و اسناد بین المللی حقوق بشر دارای مسئولیت کامل بوده و در قبال این فلاکت و رخداد تلخ باید پاسخگو باشد و “حق اعتراض” این مردم مظلوم را به رسمیت بشناسد و نسبت به درمان و جبران خسارات وارده به آنان اقدام نماید. واقعیت مسئله این است که رفتار و اقدام حکومت در قبال شهروندان خود مبتنی بر کرامت انسانی نیست و این امری محکوم و مذموم است.
ما جمعی از حقوقدانان و وکلای دادگستری ایران ضمن پشتیبانی حقوقی و قانونی از این ستمدیدگان خواستار ورود سازمان بهداشت جهانی به موضوع فوق هستیم تا با انجام تحقیقات مستقل موضوع را روشن، و خواستار محاکمه عادلانه مسببین و مقصرین امر هستیم.

Declaration by a group of Iranian Lawyers in support of oppressed people of Chenar-e Mahmudi village in Rig Rural District, in the Central District of Lordegan County, Chaharmahal and Bakhtiari Province
“While supporting Lordegan people as lawyers, we demand World Health Organization intervention to this specific issue”

Dear people of Iran,
Dear Noble Lors and Bakhtiaris,
We the signatories of the present declaration, as a group of lawyers, referring to International Declaration of Human Rights, The Charter of Patients’ Rights and Hippocratic Oath, hereby announce:
All citizens are entitled to have access to medical care and healthcare protection and governments are obliged to provide such services pro bono and based on the most appropriate international standards while guarantees their dignities. On the other hands being aware of the process of medical care, and the relationship between the patient and physician must be based on respecting the Patient’s Rights and medical ethics and morals. Despite all the given facts, unfortunately mismanagement in health system in Islamic Republic has resulted in more than two hundred people of Chenar-e Mahmudi village being infected and diagnosed as HIV positive. Lack of civil embodies and independent and fair judicial system in Iran all causes to have no exact and definite information regarding how the HIV Virus has been transferred to that village but what is notable and inevitable in this matter is intentional negligence of the present regime which has occurred in the past as well i.e. the case known as the bloods infected by HIV and Hepatitis which has been proved and the government was convicted in that regard based on articles in third chapter of Islamic Republic Constitutional Law, tortious liability and international documents about Human Rights. Nevertheless, Government must accept its role in this disastrous situation and recognize the “right to oppose” against it by the oppressed infected people and take immediate actions and remedies to compensate and provide proper pro bono medical care to them. What needs to be born in mind is the fact that the behavior of the Islamic Republic Regime towards them is against dignity which is condemned.
As a group of Iranian Lawyers under the oath to stand for people’s rights, while announcing our legal support to these oppressed people and condemn the present situation, demand WHO to intervene and by its impartial investigations clarify the causes of this disaster and demand a fair trial for those in charge about this situation.
