خطاب به دبیرکل سازمان ملل متحد: گزارشی هولناک و دهشتناک از آنچه که این روزها در سرزمین خونین و ملتهب ما ایران می‌گذرد

ما امضا کنندگان این نامه توجه آن مقام عالی رتبه را به گزارشی هولناک و دهشتناک که این روز هادر سرزمین خونین و ملتهب ما ایران که جنبش دوران ساز”زن، زندگی، آزادی” تمامی کرانه های ان را در نوردیده است ،جلب می نماییم:

۱. اعدام هولناک و شتابزده و فراقانونی جوان معترض ۲۳ ساله ایرانی، محسن شکاری که بیش تر به ” دادگاه های صحرایی و جنگی”مشابهت دارد، سرزمین و مردم مارا دربهت و حیرت و اندوهی سنگین فرو برده است..این جوان شجاع که برای احقاق حق و مطالبه ی نان و ازادی به کف خیابان امده بود ،صرفا برای شرکت در تظاهرات در تهران، و بر فرض صحت اظهارات حکومت در استفاده از سلاح سرد، مطابق قانون، از حق دفاع مشروع خود استفاده کرده بود ، در دادگاه غیر قانونی انقلاب بدون حضور وکیل انتخابی و فرصت دفاع و نقض آشکار قوانین موضوعه ی جمهوری اسلامی ،از جمله قانون اساسی ،قانون محازات اسلامی،آیین دادرسی کیفری و میثاق های بین المللی که ایران به آن ها ملحق گردیده است ،شتابزده محکوم گردید.

۲. ما امضاکنندگان این نامه که مخالف اصولی مجازات “غیر انسانی و ضدبشری اعدام هستیم ،ضمن محکومیت شدید این جنایت و ازآن جا که دادگاه های انقلاب اسلامی در سراسر ایران و بویژه تهران مبادرت به صدور حکم اعدام چندین انسان معترض که تنها جرم آنان شرکت در تظاهرات مسالمت آمیز جنبش زن زندگی آزادی ،بوده است،برای جلوگیری حتمی از اجرای این احکام غیر قانونی و ضد بشری که در صورت اجرای ناباورانه، خانواده های زیادی را عزادار خواهد کرد،ازآن مقام که بر رفیع ترین جایگاه آن سازمان معتبر تکیه زده و خود دارای کارنامه ی پرافتخار سوابق حقوق بشری می باشند ،مصرانه استدعا داریم با استفاده از اهرم قانونی و استمداد از جامعه ی جهانی و ووجدان بیدار در سراسر جهان صریحا و سریعا ازدولت جمهوری اسلامی توقف احکام صادره را خواسته و پیرو محکومیت جمهوری اسلامی در شورای حقوق بشر،از این دولت بخواهند روند محاکمات غیر قانونی معترضین اعم از کودک و غیره را متوقف ودر آینده نیز مطابق قوانین داخلی و استانداردها و میثاق های بین المللی و با حضور وکیلان مستقل برگزار نمایند.

۳. در تمامی شهرهای ایران محاکمات معترضین را با هدایت مقامات امنیتی و اطلاعاتی ودر شعبات ویژه ای که درآن قضاتی مشغول انجام وظیفه می باشند که ضمن نقض گسترده و فاحش قانون و معیار های انسانی ،در کمال تاسف و بر خلاف “سوگند قضاوت”احکامی تکان دهنده، هولناک و غیرقانونی صادر می کنند.

۴. اطمینان کافی داریم تنها واکنش سریع عالی جناب و افکار عمومی جهانی و دولت های دموکراتیک و آزادی خواه و شحصیت های تاثیر گذار و انسان دوست می تواند ماشین اعدام و سرکوب دولت جمهوری اسلامی را متوقف کند.

Your Excellency, Secretary António Guterrez,

We, the signatories of this letter, wish to draw your attention to the horrifying and disturbing reports that envelop are bloodied and troubled land since the epoch making “woman, life, freedom” movement emerging in all corners of this land:

۱) The horrifying, hasty and extra-judicial execution of a 23 year old protestor, Mohsen Shekari, which resembled “Kangaroo and war time court.” His fate has plunged our country into deep shock and heavy sorrow. This brave young man who had joined the protests to claim his right to freedom. For merely participating in the protests in Tehran, even assuming the regime’s allegations about use of a cold weapon, exercising his right to self-defense, he was hastily condemned in an illegitimate revolutionary court, without a lawyer of his choice present, without an opportunity to defend himself, and in clear violation of the Islamic Republic’s position, namely the constitution, Islamic law, the code for criminal prosecution, as well as international treaties and conventions to which Iran is party.

۲-We, the undersigned, all of whom are fundamentally opposed to capital punishment for its cruel and inhumane nature, strongly condemn this murder and since the revolutionary courts across Iran, especially Tehran, have issued death sentences for several protesters whose only crime is peaceful participation in the “woman, life, freedom” protests, with a view to immediately prevent these illegal and inhumane sentences from being imposed, which would make many families grief stricken, urgently ask your excellency, as the highest authority at this august institution, and as a man with a distinguished record in human rights, to use every legal lever to mobilize the international community and draw on the awakened conscience of the world, to directly and immediately call on the Islamic Republic to cease issuing such sentences. Following the condemnation of Iran at the UN Human Rights Council, to demand that the Islamic Republic to end the illegal judicial trials of the protesters, from children to others and that in the future to act according to domestic law as well as international laws and standards, with independent lawyers present…

۳-In all the cities of Iran, the trials of the protesters, guided by security and intelligence officials,takes place in special branches where the judges on duty are not only responsible for the extensive and explicit violation of the law and humanitarian norms, but issue shocking and horrifying verdicts which, sadly, violate their oath of office.

۴-We are sufficiently confident that it is only with your immediate reaction, that of world public opinion, as well as democratic governments in the free world, together with enlightened radical thinkers who love humanity that we can stop the machinery of executions and repression in Iran.
